In today's society, there are various legal issues affecting same-sex couples and lesbian, gay, bisexual, transgender (LGBT) individuals. It is important to discuss with an experienced attorney all of the rights available to you under the law.

Representation for Civil Unions and Domestic Partnerships

Since the passing of the Illinois same-sex marriage bill in 2014, homosexual couples have the same rights as every other married couple. However, some couples still opt to remain unmarried and enjoy their relationship in a civil union. Although civil unions offer same-sex couples similar advantages found in a traditional marriage, civil unions are not recognized in all states and are not yet recognized by the federal government.

Same-sex couples who decide to continue their relationship without getting married and entering into a civil union are able to access important legal rights, such as:

  • The right to make medical decisions on behalf of a partner if he/she becomes incapacitated.
  • The right to jointly file state income tax returns.
  • The right to have medical coverage under a partner's health insurance policy.
  • Certain survivorship rights in the event of the death of a partner.

However, before entering into a civil union, it is important to consult with a knowledgeable attorney to discuss the full extent of the benefits offered and any additional planning which may be necessary.

Domestic Partnership Agreements

Fortunately for same-sex couples, in 2013, the Federal Defense of Marriage Act prohibiting homosexual couples from receiving any federal benefits typically available to opposite-sex married couples was ruled unconstitutional. The old law posed a problem for same-sex couples, particularly under the federal tax laws. In some instances it used to be beneficial for same-sex couples to enter into a domestic partnership agreement to ensure the protection of the relationship and to minimize any potential tax liability.

There are still situations in which same-sex couples choose not to get married. In these cases, a domestic partnership agreement can be enacted. Consult with a knowledgeable DuPage County family law attorney, who has extensive years of experience with drafting contractual agreements between same-sex partners.
