Fortunately for same-sex couples, in 2013, the Federal Defense of Marriage Act prohibiting homosexual couples from receiving any federal benefits typically available to opposite-sex married couples was ruled unconstitutional. The old law posed a problem for same-sex couples, particularly under the federal tax laws. In some instances it used to be beneficial for same-sex couples to enter into a domestic partnership agreement to ensure the protection of the relationship and to minimize any potential tax liability.

There are still situations in which same-sex couples choose not to get married. In these cases, a domestic partnership agreement can be enacted.
