Same-sex couples will be delighted to know that 10 years ago, the Federal Defense of Marriage Act, which prohibited gay couples from receiving the same federal benefits that heterosexual couples enjoy, was deemed unconstitutional. This law posed many complex problems for same-sex couples, mainly regarding specific federal tax laws. In some cases, it was helpful for same-sex couples to enter into a domestic partnership agreement, which ensures not only the protection of the relationship but also minimizes tax liabilities. Even still, there remain instances where two people may decide that they wish not to be married but instead enter into a domestic partnership.
